David A. Roth

David A. Roth, founding Partner of Roth & Roth, LLP admitted in 1992 to the bars of  New York, New Jersey, US Eastern and Southern Districts of NY. Additionally, he has been admitted to try cases in the states of California and Virginia. He is a 1988 graduate of the University of Buffalo. He earned his JD from Albany Law School in 1991. He is a member of the Board of Directors of the New York State Trial Lawyers Association and is active in lobbying efforts as well as participating in various Committee projects. He is also a member of the national trial lawyers association now known as the  American Association for Justice and is a member of the National Employment Lawyers Association.  David Roth has lectured on topics from general personal injury practice to technology in the courtroom.

In the course of his involvement with the Trial Lawyers Association, David Roth has been able to fight not only for his clients’ rights but the rights of all New Yorkers.

The typical accident victim is in a David v. Goliath situation. A person gets injured and to receive fair compensation has to go up against the unlimited resources of municipalities, insurance companies and large corporations. Often accident victims feel overwhelmed and are in desperate need of good advice and help when they are at their weakest. When asked by his kids what he does for a living, David says,  “I fight for people who cannot fight for themselves.” He has spent his career fighting for those people who have had their lives devastated by the negligence of others, victims who have had loved ones injured, their civil rights trampled upon and have  had deaths in their families that  could have been avoided by simple precautions taken by the wrongdoers, corporations or municipalities.

In 1993 he was asked to take over the law practice of Herbert Gordon, an attorney who had passed away, based on his  reputation for honesty and hard work. Then again in 1998 shortly after partnering up with his wife Audra Roth he was asked to take over the practice of Stanley Roy Root, who had taken ill. The clients of both these outstanding lawyers formed the core of our client base and remain loyal to us to this day.

David Roth has been litigating cases involving all areas of personal injury on behalf of plaintiffs for approximately 20 years. Recently his practice has concentrated on complicated municipal liability as well as Traumatic Brain Injury (TBI) and other significant injury cases.

David Roth has been lecturing for both the New York State Trials Lawyers Associations and  and New Jersey Association for Justice for many years. He has chaired the Subway Series lecture focusing on cutting edge issues litigating against the Transportation Authorities. He has lectured on technology in the Courtroom, Exhibits on the Fly, New York Municipal Law for the New Jersey Practioner, Motion practice regarding advanced tactics in auto litigation and other topics., He has been published regarding the strategic prosecution of traumatic brain injury cases, litigating bus accident cases, as well as practice pieces on topics such as conducting depositions.  David Roth consistently assists many other lawyers with brain injured clients to help them to understand and evaluate the depth and breadth of their client’s injuries. David and his wife, Audra, are partners in the firm and live with their 2 children in Nassau County.
